Terms and Conditions of Sale

1. Scope of Agreement

By purchasing phenakite from WOODY'S PHENAKITE (the "Seller"), the Buyer agrees to be bound by these Terms and Conditions. These terms supersede any prior discussions or marketing materials.

2. Authenticity and Grading

Guaranteed Authenticity: Seller guarantees all specimens are genuine phenakite.
Grading Standards: Gemstone grading (clarity, color, and cut) is subjective. While we strive for accuracy, slight variations in perception may occur.
Certification: If a stone is sold with a third-party lab certificate (e.g., GIA, GRS), that certificate serves as the final word on the stone’s attributes.

3. Pricing and Payment

Currency: All prices are listed in AUD.
Volatility: Due to the rarity of phenakite, prices are subject to change without notice until a deposit or full payment is received.
Taxes/Duties: The Buyer is responsible for all applicable sales tax, VAT, or import duties required by their jurisdiction.

4. Shipping and Risk of Loss

Insurance: Given the high value of phenakite, all shipments will be fully insured.
Transfer of Risk: Risk of loss passes to the Buyer once the package is marked as "Delivered" by the carrier.
Inspection: Buyer must inspect the specimen within 48 hours of receipt and report any damage or discrepancies immediately.

5. Return and Refund Policy

Review Period: Buyers have a 48 hour inspection period. If unsatisfied, the item must be returned in its original, unaltered condition.
Restocking Fee: A restocking fee of 20% may apply to cover insurance and handling costs.
Custom Orders: Custom-cut stones or specially sourced specimens are non-refundable.

6. Disclaimer of Metaphysical Claims

Note: Many phenakite buyers seek the stone for its purported "high-vibration" properties.

No Medical Advice: Any descriptions regarding the metaphysical or healing properties of phenakite are for entertainment/spiritual purposes only and do not constitute medical or psychological advice. Seller makes no guarantees regarding the "energy" or "efficacy" of the stones.

7. Limitation of Liability

To the maximum extent permitted by law, Woody's Phenakite shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or use of our products. Our total liability is limited to the purchase price of the item in question.

8. Governing Law

These terms are governed by the laws of New South Wales Australia. Any disputes shall be resolved in the courts of Sydney.

Return and Refund Policy

Return & Refund Policy

Thank you for choosing Woody's Phenakite. Because our Burmese Phenakite specimens are of the highest rarity and value, we maintain a strict return protocol to ensure the integrity of our inventory and the security of our logistics.

1. 2-Day Inspection Period

We want you to be certain of your acquisition. You have 2 calendar days from the date of delivery to initiate a return. If 2 days have passed since your specimen was delivered, we unfortunately cannot offer you a refund or exchange.

2. Return Conditions

To be eligible for a return, the following conditions must be met:

Unaltered State: The gemstone must be in the exact condition in which it was received. We cannot accept returns on stones that have been cut, polished, set in jewelry, or damaged.
Security Seals: If the specimen arrived in a sealed security bag or with a tamper-evident tag, these must remain intact.
Documentation: All original certificates (GIA, GRS, etc.) and grading reports must be returned. A $250 fee will apply for any missing third-party certificates to cover the cost of re-certification.

3. The 20% Restocking Fee

All authorized returns are subject to a 20% restocking fee.

Why this fee exists: This fee covers the specialized costs associated with high-value gemstone logistics, including non-refundable merchant processing fees, outward fully-insured shipping costs, and the mandatory professional gemological inspection required to verify the stone's identity and condition upon its return.

4. Return Shipping

Authorization: You must contact us at Phenakitesocialmedia@gmail.com to receive a Return Merchandise Authorization (RMA) before shipping.
Cost & Risk: The buyer is responsible for all return shipping costs.
Insurance Requirement: Returns must be sent via a trackable, "Signature Required" service and must be fully insured for the original purchase price. We are not responsible for items lost or damaged during return transit.

5. Inspection and Refunds

Once your return is received, it will undergo a professional inspection to verify its authenticity and condition.

Approval: If the stone is verified to be in its original state, your refund (minus the 20% restocking fee) will be processed to your original method of payment within 5-10 business days.
Rejection: If the stone shows signs of wear, damage, or alteration, the return will be rejected, and the item will be sent back to you at your expense.

6. Non-Returnable Items

Custom-cut gemstones or "made-to-order" jewelry pieces.
Items purchased during a "Final Sale" or "Clearance" event.
Specimens that have been modified by a third-party jeweler.
